Yum Fiesta reserves the right to change or update Privacy Policy or Terms, or any other guidelines, rules and regulations at any time and at its sole discretion without any notice, so please come back and review them. If any future updated versions of the Terms, our Privacy Policy, or any other rules, controls or guidelines require any action from you in order to accept them, then you may not be able to continue to use the Services until you have taken such action.

On account creation process, you will be required to select a password (“Login Information”). You shall not share the Account or the Login Information, nor let anyone else access your Account or do anything else that might risk security of your Account. You acknowledge and agree that your account is personal to you and that you are not entitled to transfer your account to any other person.

You acknowledge and agree that if you delete your account, or if we delete your account in accordance with these Terms, you may lose access to any data with regard to your account, including but not limited to, your game progress, the score you have reached through the Services, any Virtual Currency or Virtual Goods, and other data, information, content and materials relating to your account.

You shall not sell, rent or give away your Account, create an Account using a false identity or information, or on behalf of someone other than yourself; you shall not use the Service if you have previously been removed by Yum Fiesta, or previously been banned from playing any Yum Fiesta game.

You shall use your Account only for non-commercial purposes; do not use the Service to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk or spam e-mail or repetitive messages to anyone.

You represent that all information, data, correspondence, including without limitation any chat text, picture, graphics, sound, video, labels, or other materials ("Content") that might be transferred, transmitted, sent, communicated or else made accessible through our Services by you will stay precise, complete and genuine.

It will be your sole responsibility, if your content is uploaded, transmitted, communicated, sent or made accessible through our services by you, whether posted publically or privately. When you use our services, you acknowledge and agree that there may be invasive, offensive or objectionable material.

Yum Fiesta reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) without notice for any reason or for no reason at any time.

Yum fiesta services may include virtual currency, such as virtual coins, diamonds, points or similar items, (“virtual currency”) and virtual digital items, such as abilities, useful items or other goods (“virtual goods”), all for use in yum fiesta’s services.

Yum fiesta hereby reserves the right to manage, control, regulate, change or eliminate virtual currency or virtual goods or the price and availability of virtual currency or virtual goods without any liability to you at any time and at its own discretion without prior notice.

You acknowledge and agree that Yum Fiesta is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused virtual items when an account is closed, whether such closure was voluntary or involuntary.

Yum Fiesta reserves the right to terminate or suspend access to its Services (deleting an account) if it considers that you are in violation of these Terms (considering one major violation or a combination of minor violations).

Yum Fiesta is hereby authorized to refuse or limit any access to the Services for any reason and without any notice, including but not limited to any violation of these Terms. You acknowledge that Yum Fiesta is authorized to discontinue or change the Service and/or its content at any time, without liability and with or without notice to you, the user."

Yum Fiesta shall not be liable to you for any incidental, indirect, consequential, special, and punitive or other similar damages, including but not limited to loss of revenues, lost profits, lost data or business interruption or other intangible losses. Arising out of or relating in any way to these terms of service or the service itself, whether based on contract, tort or any other legal theory, and whether or not Yum Fiesta has been advised of the possibility of such damages. Yum Fiesta shall not be liable to you for more than the amount you have paid to Yum Fiesta in accordance with these terms of service in the six months immediately preceding the date on which you first declare a claim. The exclusions and limitations of damages are fundamental elements of the basis of bargaining between Yum Fiesta and you.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above disclaimers and limitations may not apply to you. To the extent that Company may not, as a matter of applicable law, disclaim any warranty or limit its liability as set forth herein, the scope of such warranty and the extent of Company’s liability shall be the minimum permitted under such applicable law. In particular, nothing in these terms of service shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from any negligence or fraud of Yum Fiesta.

The Software may contain links to third party websites or services that are not owned or controlled by Company. When you access third party websites or services, you do so at your own risk. Company has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or services. Moreover, Company will not and cannot monitor, verify, censor or edit the content of any third party site.

Any disappointment on the part of Yum Fiesta to exercise any and all rights or conditions under these terms shall not constitute a disclaimer of said rights or provisions, and should any party hereof waive any violation or default in these Terms, it should not be interpreted as a waiver of any prior or later violation or default.

Any Act of God or other force majeure, such as war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials or any other cause outside of Yum Fiesta’s control, Company shall not be liable for any delay or failure of the Services’ provision."
